SQUAMISH NATION REACTS TO FEDERAL COURT OF APPEAL RULING ON FEDERAL CONSULTATION ON TRANS MOUNTAIN EXPANSION PROJECT

February 4th, 2020, Vancouver, BC (Musqueam, Squamish and Tsleil-Waututh Territory) – The Squamish Nation is extremely disappointed with today’s Federal Court of Appeal (FCA) decision to uphold the second federal approval of the Trans Mountain Expansion (TMX) Project. The Squamish Nation maintains that significant uncertainties and risks remain associated with the project in unceded Squamish Territory, and that these have not been adequately addressed to-date.

“There is a lot in the Federal Court of Appeal decision that concerns us. The TMX Project continues to be a threat to our coastline and community in the case of a pipeline leak or tanker spill. This project will harm our communities, our people, and the jobs our people rely on in the Vancouver area. Canada was ordered to try again at meaningfully consulting with our Nation, but treated us with the same contempt as the first time, when the Courts deemed that Canada’s attempt to consult ‘fell well short of the mark’,” said Khelsilem, Squamish Nation Councillor and Spokesperson.

The Nation will continue pursuing its separate legal challenge in the Supreme Court of Canada and work with its legal team to assess the full impact of today’s decision by the FCA. In the coming days and weeks, Squamish will be looking at options for appealing the decision.

The Squamish Nation has separately and previously sought leave to appeal the FCA’s September 4th, 2019 decision, which granted leave to six First Nations, including the Squamish Nation, but significantly limited the grounds upon which the First Nations could argue. In December 2019, the FCA heard the Squamish Nation’s challenges to the June 2019 Federal Cabinet re-approval of the TMX.

Today’s decision is one of many legal decisions to come that will decide the fate of the TMX Project.
