The Squamish Nation Responds (Part 2): Capilano RV Park

This is the second in a series of seven posts. The intention is to provide a transparent, truthful and clear accounting of the facts.

These are Squamish Nation responses to some of the public statements made by members of the Partnership (Dennis L. Baker, Frank J. Baker, Darlene  Garrick, Pamela Baker, Wayne C. Baker and Wade S. Baker and we understand, Lucy Emily Baker) that operated the Capilano Mobile and RV Park.

Issue #2

MEMBER OF PARTNERSHIP:

“WE are still in court today ‘BY COURT ORDER’.”

SQUAMISH NATION RESPONSE:  The Partnership makes its own decisions to continuously bring proceedings before the court.

The Nation has succeeded in every single court application, whether it be in the Squamish Action or the Partnership’s action and it would be unnecessary for the Nation or the Partnership to go to court if the Partnership did not take unreasonable positions that are contrary to well-established legal principles.

Issue #1

MEMBER OF PARTNERSHIP:

“WE are in court because of the Actions of Squamish Chief and Council”

SQUAMISH NATION RESPONSE:

The Nation was initially forced to bring an Action against the Partnership after the Partnership refused to make any rental payments to the Nation for a period of over 6 months, refused multiple offers by the Nation to discuss matters and insisted repeatedly that the Nation had no right to collect any rent.

Since succeeding in that claim, the Nation has been forced to continually defend the rights of all Squamish Nation members, as the Partnership continues to bring proceedings before the court.  The Partnership continues to bring actions before the court, despite numerous court decisions in favour of the position of the Squamish Nation.   Most recently, the Partnership has filed another claim against the Nation on May 28, 2013.
